In case of vertical agreements restricting competition the undertaking has another option to use the concept of “settlement”. Settlement allows the person violating the Act on Protection of Competition to gain benefit in the form of reduced fine up to the amount of 50% if this person voluntarily acknowledges his/her participation in the infringement and bears liability for such actions.

Settlement could be applied also in the case of restriction of competition state administration authorities and self-administration authorities (§ 39), where the Office reduces the fine up to 50% of the previous fine provided the acknowledgement of the participation in the infringement and assumption of responsibility for such actions.

Conditions for the application of settlement procedure are specified in the Decree on Settlement.
