CARTELS: AMO SR conducted the unannounced inspections at the premises of undertakings in laboratory technology supply market

The Antimonopoly Office of the Slovak Republic (hereafter “the Office”) confirms the unannounced inspections at the premises of undertakings acting in laboratory technology supply market between 7 and 9 June 2016.
 
The inspection was carried out on the basis of a reasonable suspicion that the undertakings acting in the laboratory technology supply market might have concluded an agreement restricting competition relating to participating and submitting bids in public procurement, public tender or other similar tender announced within the frame ofOperational Programme Research and Development. The suspicion related to the tender announced by a contractor acting in the field of biomedicine and with the contract price over EUR 3.000.000 exclusive of VAT. The object of contract was the laboratory technology supply relating to infrastructure development within the scope of oncological diseases diagnostics.
 
Whereas it concerns horizontal agreement between direct competitors, which is ranked among the most serious violations of competition rules and considered as hard core cartel, in the case of proving infringement, the undertakings may be fined a sum equal to 10% of the turnover of their previous accounting period.
 
The fact that the Office made the inspection does not imply that entities concerned have infringed the competition rules, nor does it prejudge the conclusion of investigation. The Office does not provide further information at this stage of investigation.
