Cartel in the field of geodesy and cartography

On November 13, 2014 the Division of Cartels issued a decision by which it imposed the fines in the total amount of EUR 498 202 on two undertakings acting in the market of production, distribution and sale of goods and services in the area of mapping the earth's surface and products of aerial photogrammetry.

The findings of the Office show that during the years 2005 – 2013 the undertakings were coordinating their activities in the relevant market, namely in relation to price fixing and other trade conditions of products distribution, as well as in relation to market allocation, both for the purposes of production of photogrammetry products and for their subsequent distribution. Undertakings also agreed on coordinated conduct towards customers during the public procurements and public tenders or other procedures which these customers implemented with a view to obtain the best possible deals on the market. Such conduct of undertakings caused harm to their customers, which included also public sector entities. The Office concluded that the conduct of undertakings constitutes agreement restricting competition pursuant to the Article 4 of the Act on Protection of Competition No. 136/2001 Coll. in its valid wording and also the Article 101 of the Treaty on the Functioning of the European Union.  

Since it is a first-instance decision which could be appealed by the undertaking concerned, the Office does not provide any details on this decision.
