CARTELS: AMO SR initiated the administrative proceedings for the failure to submit information requested by the Office within stipulated time

On 15 March 2019 the Antimonopoly Office of the Slovak Republic, the Division of Cartels, (hereafter “the Office”) initiated the administrative proceedings in the matter of the failure to submit requested information within stipulated time. The Office initiated the administrative proceedings against an undertaking, in relation with the public procurement for information technology supply.
 
Pursuant to the provisions of the Article 22 Paragraph 2 of the Act on the Protection of Competition (hereafter “the Act”), the Office is empowered by the right to request from undertakings information and documentation, which are necessary for its activity. In this case, the Office has repeatedly requested the submission of information by the undertaking, which carried out the public procurement for the contracting authority. Despite the urgencies, the undertaking did not provide the requested information to the Office.

According to the provisions of the Article 38a Paragraph 1 of the Act, the Office imposes a fine of up to 1 % of turnover for the previous accounting period for the infringment of the obligation to submit the documentation or information to the Offce within stipulated time, for the submission of false or incomplete documentation or information, or for the failure to allow the Office to verify them.
