AMO SR imposed a fine for submitting false and incomplete documentation and information

On 26 January 2017 the Antimonopoly Office of the Slovak Republic, the Division of Abuse of a Dominant Position and Vertical Agreements, (hereafter “the Office”) issued a decision, by which it imposed a fine in the amount of EUR 37 666 on an undertaking for breaching an obligation set by the Article 22 Paragraph 2 of the Act on the Protection of Competition.

During the investigation the Office requested documentation and information relevant for the investigated area from the undertaking. The undertaking infringed the obligation set by the Article 22 Paragraph 2 of the Act by submitting false documentation and information.

The power to request documentation and information during an investigation is one of the most important and most frequently used investigative powers of the Office, which enables it to reveal the infringements of the provisions of the Act on the Protection of Competition. Not submitting complete and true documentation and information within the time stipulated by the Office leads to a distortion of a proper and efficient detection of anticompetitive conduct. It also leads to the need to carry our further actions by the Office in order to obtain the required documentation and information, which has a negative impact on the efficiency of the exercise of the Office´s powers.

The decision of the Antimonopoly Office of the Slovak Republic is not valid.

Since this is the first instance decision against which the party to the proceedings may appeal, at this stage the Office does not provide more details on this decision.
