CARTELS: AMO SR initiated an administrative proceeding for a possible cartel agreement in the public procurement of construction works in energy sector

On 24 February 2021 the Antimonopoly Office of the Slovak Republic, the Division of Cartels, (hereafter "the Office") initiated, based on its own initiative, an administrative proceeding in the matter of a possible agreement restricting competition, pursuant to the Article 4 of the Act on Protection of Competition, concluded between undertakings in the public procurement of a contract in the field of construction works.
Based on investigation carried out, the Office obtained documentation and information indicating that three undertakings had coordinated their procedure in submitting bids in the public procurement, the subject of which had been the provision of construction works in the field of energy.
The contract was financed from the EU structural funds under the Operational programme Quality of Environment.
The initiation of administrative proceedings does not mean that parties to the proceedings infringed competition rules, nor does it prejudge conclusions that the Office may reach in its decision.
