ABUSE OF DOMINANT POSITION: AMO SR imposed fine of almost 298 thousand euros for the abuse of dominant position in the field of waste management

AMO SR evaluated the conduct of undertaking as the practice of applying unfair trading conditions.

On 31 January 2022 the Antimonopoly Office of the Slovak Republic, the Division of Abuse of Dominant Position and Vertical Agreements, (hereafter “the Office“) issued a decision, by which it imposed a fine in the amount of EUR 297 533 on an undertaking operating in the field of waste management for the abuse of dominant position.

The Office´s findings showed that since the year 2019 the undertaking in dominant position has been applying significantly higher prices for the landfilling of mixed municipal waste towards some municipalities compared to other municipalities, without objective justification.

The Office evaluated the conduct in question as the practice of applying unfair trading conditions pursuant to the Article 5 Paragraph 3 Letter a) of the Act on Protection of Competition.

The decision has not come into force yet. The participant to the proceeding may file an appeal against the decision within a time limit set by the Act.
