AMO SR conducted unannounced inspections at undertakings in the area of purchase, sale and distribution of original ink and toner cartridges

The Antimonopoly Office of the Slovak Republic, the Division of Abuse of Dominant Position and Vertical Agreements, (hereafter "the Office") confirms that from 10 April 2018 to 12 April 2018 it conducted an unannounced inspection at the premises of undertakings operating in the area of purchase, sale and distribution of original ink and toner cartridges to printers, copiers, facsimiles or other such devices serving the similar purpose in the territory of the Slovak Republic.
 
The inspection was carried out on the basis of a reasonable suspicion that in the area concerned there could be agreements restricting competition and/or abuse of dominant position, namely in connection with participating and submitting bids in public procurement announced in the abovementioned field. The Office considered it necessary to investigate the suspicion of a possible infringement of competition rules by the representant of one of the brands operating in the given area within the Slovak Republic and/or by the end distributors.
 
If the infringement is proved, the Office may impose fines on the undertakings up to 10 % of their turnover for the previous closed accounting period.

The fact that the Office conducted the inspections does not imply that the parties concerned have infringed competition rules nor does it prejudge the conclusions of the investigation.
 
At this stage the Office does not provide any further information about the investigation.
