CARTELS: AMO SR conducted an unannounced inspection at an undertaking operating in the sector of providing services in the area of public procurement

The Antimonopoly Office of the Slovak Republic, the Division of Cartels, (hereafter “the Office”) has confirmed that on 3 December 2019 it conducted an unannounced inspection in the business premises of an undertaking operating in the sector of providing services in the area of public procurement.

The Office conducted the inspection on the basis of a reasonable suspicion of the possible participation of the undertaking operating in the sector of providing services in the area of public procurement either in the preparation of an agreement restricting competition, the conclusion of such an agreement or helping to its realization.

This anticompetitive behaviour concerns the participation and the submission of bids in selected public procurements for the supply of construction works for the modernization of public lighting in municipalities, partially financed by the means of ERDF, of the operational programme KaHR.

As this could be a horizontal agreement between direct competitors, which is ranked among the most serious infringements of competition rules and is considered as a hard-core cartel, if such an agreement is proved, the undertakings may be fined of up to 10 % of their turnover for previous financial year.

The fact that the Office conducted an inspection does not imply that the entities concerned have infringed competition rules, nor does it prejudge the conclusions of the investigation.

 At this stage, the Office does not provide further information on the investigation.
