On 9 November 2022 the Antimonopoly Office of the Slovak Republic, the Division of Cartels, (hereafter "the Office"), based on its own initiative, initiated an administrative proceeding in the matter of a possible agreement restricting competition pursuant to the Article 4 of the Act on Protection of Competition, concluded between several undertakings in connection with a public procurement and a public tender, the subject of which was the purchase and delivery of machines for forming and machining metals.

On the basis of investigation conducted, the Office obtained documentation and information indicating that four undertakings had coordinated their procedure for submitting bids in the public procurement and the public tender, which should have resulted in the victory of a specific bidder.

The public procurement, respectively the public tender should have been financed from the structural funds of the European Union within the Research and Innovation operational programme.

The initiation of administrative proceeding does not imply that the participants to the proceeding infringed competition rules, nor does it prejudge the conclusions that the Office can reach in its decision.
