ECN published collection of recommendations

Within the European Competition Network (ECN) the competition authorities and the European Commission adopted recommendations on key investigative and decision-making powers for the area of competition. Recommendations include general principles and minimal standards for investigation tools which the authorities should have for the efficient application of competition rules. They are derived both from praxis and existing judicature. They may serve as guidelines for those involved in establishing the law framework for application of the Articles 101 and 102 of the Treaty on the Functioning of the European Union, but they do not interfere in the jurisdiction of particular states. Namely there are seven recommendations in which the competition authorities present their common attitude towards:
  • investigative powers, enforcement measures and sanctions in the context of inspections and requests for information
  • the power to collect digital evidence,
  • assistance in inspections conducted under Articles 22(1) of Regulation (EC) No. 1/2003,
  • the power to set priorities,
  • intermin measures,
  • commitment procedures,
  • and the power to impose structural remedies.
