Methodological Guideline on Ensuring the Uniform Application Procedure for Providers of Ad hoc De Minimis Aid

On January 1, 2016 the Act No. 358/2015 Coll. on Adjustment of Certain Relations in State Aid and De Minimis Aid and on Amendments and Supplements to Certain Acts (hereafter referred to as „Act on State Aid“) entered into force. Pursuant to Article 2 (2) b) of the Act on State Aid the aid coordinator shall prepare opinions on proposals to provide ad hoc aid. Based on Article 8 (3) of the Act on State Aid each provider of de minimis aid is obliged, prior to providing the ad hoc de minimis aid, to request the aid coordinator for its opinion whether the particular measure meets the terms and conditions for providing de minimis aid pursuant to special regulations on de minimis aid. The aid coordinator has issued this Methodological Guideline on Ensuring the Uniform Application Procedure for Providers of Ad hoc De Minimis Aid, which stipulates in detail the terms and conditions of applications submitted by the providers of ad hoc de minimis aid. These terms and conditions serve as the basis for assessment whether the relevant measure meets the terms and conditions to provide the aid pursuant to the Commission Regulation No. 1407/2013 of 18 December 2013 on application of Articles 107 and 108 of the Treaty on the Functioning of the European Union for de minimis aid.
